  1. QUOTE: President Biden promised to choose a black woman as vice president, and then made the same promise for his first SCOTUS nominee. Is that good for the country?

Why would this be a question now…given this type of targeted talent search has been an established practice within the US government? We seen it with previous SCOTUS nominees by Reagan (O’Connor) and Trump (Barrett) and Bush (Thomas). Interestingly, with the nomination process that resulted in Judge Barrett the notion of nominating a woman was met with cheers by Republicans. Peter Wallison, Reagan’s White House counsel said that Reagan “wanted to be sure that he could appoint the first Italian-American (Scalia) …he felt that it would be great to put an Italian-American on the Supreme Court.” According to historian David A. Nichols and political science professor Sheldon Goldman, Eisenhower told his attorney general, “I still want the name of some fine, prominent Catholic to nominate to the bench”. As well, Reagan said: “I will also seek out women to appoint to other federal courts in an effort to bring about a better balance on the federal bench.”

QUOTE: P&C expose the hypocrisy of the left in pretending to want racial, ethnic and sexual diversity on the court while opposing nominees like Janice Rogers Brown or Miquel Estrada.

Conservatives have NO credibility in exposing hypocrisy unless they are also willing to expose their own. Merritt Garland’s nomination was blocked on a phony premise. Yet, the very premise that was given for not taking up Garland’s nomination was revoked by Republicans to nominate Justice Barrett. Interestingly, Lindsey Graham voted last year to confirm Judge Jackson to an influential appeals court. Graham said he was convinced that “Judge Jackson will not be deterred by the plain meaning of the law when it comes to liberal causes.” Yet, now calls her an “activist judge”. My, my what a difference a year makes. He could won an academy award with his histrionic-laden performance during the confirmation hearings.

That said, what does quotas have to do with Judge Jackson? At the announcement of the nomination process President Biden said: The person I will nominate will be someone with extraordinary qualifications, character, experience and integrity and the person will be the first Black woman nominated to the United States Supreme Court…I will fulfill my duty to select a justice, not only with Senate’s consent but with its advice…I’m going to invite Senators from both parties to offer their ideas and points of view. I’ll also consult with leading scholars and lawyers…I will listen carefully to all the advice I’m given and I’ll study the former records and cases carefully…in the end, I’ll nominate a historic candidate…” Seems the Senate agreed with Biden’s nomination and criteria given Judge Jackson was confirmed with a higher YES vote than the two previous SCOTUS nominees (Barrett/Kavanaugh). As well, her confirmation was bi-partisan. Seems she is highly qualified and has experiences that some sitting SCOTUS justices don’t possess. So given she’s been found qualified and confirmed, what’s the issue?

QUOTE: The NFL has also entered the game of racial and sexual quotas for coaching positions, leading to ridiculous and counter-productive measures for football.

Given the NFL is a private company, what’s the problem if they decide they want to find ways to diversity the talent within their organization…especially given their curious staffing and promotion history.

  2. The more pressing question is: Is it good for the country when one party shows contempt for a legitimate decision through their stunts and antics?

    1. There are many salient questions to be asked. For instance, why wouldn’t it be good for the country to have a practice that intentionally identifies, vets and confirms highly educated, experienced, service-oriented diverse talent? As well, why is there a question about the value of quotas associated with Judge Jackson’s nomination? Seems it would have been raised when President Trump announced he would nominate a woman for the SCOTUS, if it was germane to good of the country.
